2nd Amendment

We believe resisting and defying tyrants has been interwoven into our Constitution but, more importantly, has biblical faithful precedent. Our forefathers understood that it takes an armed populace to be free. As free men and women, our highest law allows for the right to protect righteousness, our borders, and our families.

And that the said Constitution be never construed to authorize Congress to infringe the just liberty of the press, or the rights of conscience; or to prevent the people of the United States, who are peaceable citizens, from keeping their own arms; or to raise standing armies, unless necessary for the defense of the United States, or of some one or more of them; or to prevent the people from petitioning, in a peaceable and orderly manner, the federal legislature, for a redress of grievances; or to subject the people to unreasonable searches and seizures of their persons, papers or possessions.

THE RIGHT TO BEAR ARMS

Our Founding Fathers placed a premium on our God-given freedom. More than anyone, they understood that the people’s right to bear arms would ensure that our country would remain free from tyranny. Fighting for our nation’s independence was the best case study they could ever be inspired with to constitutionalize the right to bear arms. 

An armed citizenry can defend itself, prevent tyrants from taking power and help protect our country from foreign invasion. KCP fully embraces the mindset with which the Framers of our Constitution penned this amendment. 

RED FLAG LAWS & CONSTITUTIONAL CARRY

Red Flag Laws allow government authorities to take your guns if, by accusation, you are deemed dangerous to yourself or others. There is nothing in the Constitution that backs up anti-gun laws such as these. This type of legislation allows the government to seize your firearms without due process. It is Gun Control. Seventeen states already have gun control laws in place. One of them being Illinois. For years there has been a significant issue of gun violence in Chicago. Whenever there is gun control, gun violence is to be expected.

Constitutional carry legislation allows any adult to carry concealed or unconcealed, without permits. Any adult 18 years of age or older, if in the military or 21 years or older (civilians), who wants to carry a handgun should not be required to obtain any additional permits. KCP affirms this law and any other gun laws that align with the Constitution. 

REASONABLE REGULATIONS

Like anything else, our party is not opposed to reasonable regulations. We support measures that ensure this right of ours is protected but not used against the well-being of our people. KCP does not endorse any restrictions that push for gun control/bans. Under no circumstance should any policy prevent lawful gun owners from keeping and bearing arms while supposedly attempting to keep criminals from getting guns.

KCP understands that weapons don’t murder people. Criminals do. Crime is a sin. It started long ago with Cain murdering his brother Abel. It is on the rise today almost everywhere. In the UK, where it is virtually impossible to get guns, knives are the tool of choice to commit murder. Women are three times more likely to be raped there than in our country. According to a study by David Kopel, American thieves avoid occupied homes when committing burglary because of the risk of getting shot. However, British burglars prefer occupied homes as it gives them access to wallets and purses.

DEFYING TYRANTS

Matthew Trewhella in The Doctrine of the Lesser Magistrates states this: “The lesser magistrate doctrine declares that when the superior or higher civil authority makes unjust/immoral laws or decrees, the lesser or lower ranking civil authority has both a right and duty to refuse obedience to that superior authority. If necessary, the lesser authorities even have the right and obligation to actively resist the superior authority.” 

He also states: “John Knox, for example, in his Appellation to the nobles of Scotland in 1558, cites over seventy passages of Scripture to support this doctrine. Knox insisted that the nobles, as lesser magistrates, were responsible for protecting the innocent and opposing those who made unjust laws or decrees.”  

We would not be surprised if the 2nd amendment were written with the doctrines of the Lesser Magistrates and Interposition in mind. The Doctrine of Interposition is the calling of God that requires someone to stand in the gap for another.
